Agreement between User and Rush Me Travels (Rush Me) :

This is an agreement (referred to as "user agreement"), and it incorporates the relevant terms and conditions for Rush Me Travels and its affiliate Companies (referred to as "Rush Me", RMT, or in the first person, such as "Us", "Our") to provide solutions, consultancy or any other services to individual(s) or organization(s) (referred to as the "User", "customer" or in the second person, such as "you") who purchase or inquiring for any service of Rush Me by using Rush Me's websites or using any other customer interface channels of Rush Me, which include, but are not limited to its personnel, office(s), advertisements, information booths, etc.

Age, Responsibility and Agreement :

At the outset, we emphasize that you may use this website if and only if you are of legal age and otherwise capable and competent of forming legally binding contracts, under the Indian Contracts Act, 1872. Persons incompetent to form contracts include minors and others listed under the Indian Contracts Act. The Users availing services from Rush Me are deemed to have read, understood and categorically accepted the terms and conditions of this agreement, without modification or exception. These terms govern all transactions and provision of such services by Rush Me for all purposes, and shall be binding on the User.

Service by RMT :

RMT provides you with this value-added service facility, so that you can make your online booking request for booking various services offered by RMT. RMT will process your booking request to confirm prices and availability, of the services requested by you. Only on confirmation to you about the prices and availability, RMT will be bound to provide you the requested services. However, these are subject to you making full payment and complying with the relevant terms and conditions. Any correspondence with you prior to RMT's confirmation, is not acceptance of your request. All bookings and booking requests of the products and services made available through this website, are subject to availability and solely at the discretion of RMT and/or its respective suppliers.

Information Provided by User :

Please ensure that all information given by you while booking is correct. The User recognizes that to be able to advice you of any developments affecting your travel, as well as for security reasons, we or our service suppliers need to be able to contact you by telephone and email, and require your correct address on record. If any or all of these contact details are not correctly given by you, we reserve the right to cancel the transaction at your risk and cost.
The right to access and transact on the web site is reserved, as is the right to use any particular service provided by RMT or on the website for payment purposes.

Privacy Policy :

Please note that RMT will try to maintain the privacy of the personal information provided by you. However, we need to provide this information to the service suppliers including Airlines and Hotels, as well as Consulates and Embassies, which are relevant to your travel. We may also be required by the court of law, or a government statutory authority under law, to disclose such information to relevant agencies. You consent to the your personal information to being provided to the aforementioned service suppliers and relevant agencies and authorities.

Interaction with Service Supplier :

The use of the services is at the sole risk of the User. RMT is essentially an intermediary between the User and the service provider such as the airline, hotel, surface travel provider, conference, and such third party services. These service providers are selected in good faith, and are provided as options to the User. However, RMT cannot and does not guarantee the services or the standards of the services provided by such service providers. RMT is not liable in any circumstances for any service or the standards of the service provided by the service provider.

Travel Endorsement :

In case of the travel and destination, RMT makes no endorsement, guarantee or claims of the safety or suitability of any travel service or destination. RMT is not liable for any loss or damages to the User by employing any travel services or travelling to any destination.

Refunds :

If any services from the service supplier such as hotel or airline or any surface travel service supplier, is not conducted, or cannot be conducted due to Force Majeure or Vis Majeure situations such as natural disaster or riot or accident, or if it is canceled by the User, then RMT or its supplier will not be responsible for any refund to the User. The same is true if the User has not made any payment to RMT or its service supplier. However, at its sole discretion, and subject to the cancellation policies of the service supplier and/or depending on the various factors such as number of participants, RMT may arrange for a refund. Such refund may be subject to relevant Bank charges and/or relevant currency exchange rates, in addition to any service charges by RMT and/or the service supplier.

Payments Due and Legal Recourses available to RMT :

The user recognizes that any violation or attempted violation of this User Agreement, as well as unpaid charges to RMT, would cause damage to RMT. Therefore, RMT is entitled to an injunction issued by a competent court or authority, restraining such violation or attempted violation. All costs and expenses in obtaining such injunction, including, but not limited to Attorney's fees, will be recoverable from the user. The same is true for recovery from the user of any unpaid balances, or of any tangible damages caused to RMT or its service supplier, which require recourse to legal processes.

Indemnity and Liability :

RMT is in no way liable or responsible for any loss whatsoever - be it direct or indirect, for any specific or consequential damage caused by employing RMT's services and those of its service suppliers such as Hotels and Airlines. The User of the Website and of RMT's services, as well as any of their relevant kith and kin, hold RMT free from any liability for any loss whatsoever - be it direct or indirect, for any specific or consequential damage caused by employing RMT's services or those of its service suppliers.

In any case, without prejudice to the above, no liability on the part of RMT arising in any way with respect to any tour, holiday, excursion facility, shall exceed the total amount paid for the corresponding tour, holiday or service, and shall in no case, include any consequential loss or additional expense, whatsoever.

Jurisdiction :

All legal disputes will be settled under laws of Indian Courts, subject to the laws of India. The first attempt will be via good faith negotiation between the parties. In case of disputes which are not resolved by negotiation within 30 days, such dispute shall be referred to binding arbitration, under the Arbitration and Conciliation Act, 1996. The arbitration will be held in Mumbai, India. In case the dispute requires intervention of courts, exclusive jurisdiction shall lie with Mumbai courts.
